Arbitr Inc Commercial Dataset License
This license governs the commercial use of all datasets published or distributed by Arbitr Inc that are derived, curated, or processed from public-domain materials such as USPTO data.
0. Definitions
Arbitr Data” — any datasets, snapshots, selections, schemas, normalized fields, indices, labels, or metadata curated by Arbitr Inc.
Source PD Data” — materials in the public domain (e.g., USPTO data under 17 U.S.C. §105).
Substantial Part” — a significant quantitative or qualitative portion of a database.
Competitor Data Product” — any dataset or service replicating or substituting Arbitr Data.
Order Form” — any invoice, contract, or subscription defining fees, access limits, and delivery channel (API, file, or custom).
1. Scope
This License governs all Arbitr Data derived, curated, or processed from public-domain materials.
Arbitr Inc asserts no ownership over raw public-domain sources, but holds intellectual property rights over the selection, normalization, enrichment, labeling, and compilation of Arbitr Data.
2. Grant (What You May Do)
Upon valid authorization via Order Form, Arbitr Inc grants a non-exclusive, non-transferable, revocable license to:
  • Use Arbitr Data internally for commercial research, analytics, and AI model training;
  • Integrate Arbitr Data into internal tools or systems;
  • Publish aggregated or derivative insights that do not reconstruct original records.
3. AttributionPublic references must include:
“© Arbitr Inc, 2025. Derived from public-domain sources (e.g., USPTO). No affiliation or endorsement by USPTO.”
Attribution or embedded notices must not be removed or altered.
4. Machine Learning ConditionsModel training is permitted provided that:
  • The model does not reproduce or extract Arbitr Data records;
  • The resulting model or service is not a Competitor Data Product;
  • No data-distillation or extraction attacks are performed;
  • Redistribution of model weights incorporating Arbitr Data requires written consent.
5. Prohibited Uses
Without prior written approval from Arbitr Inc, Licensee may NOT:
  • Redistribute, resell, or sublicense Arbitr Data;
  • Host or mirror Arbitr Data publicly;
  • Create a Competitor Data Product;
  • Remove attribution, metadata, or identifiers;
  • Circumvent access controls, rate limits, or watermarks;
  • Reconstruct a Substantial Part of Arbitr Data.
6. Compliance & Flow-Down
Licensee must ensure that any contractors or affiliates comply with these terms (“flow-down”).
Access should be limited strictly to internal authorized users.
7. Database Rights & IP Notice
Arbitr Inc claims intellectual property rights in the selection, arrangement, normalization, enrichment, labeling, and compilation of Arbitr Data, recognized under applicable database-right laws.
8. Legal Compliance
Licensee must comply with all applicable export-control and sanctions laws (U.S., EU, UK, UN).
Use of Arbitr Data in or for restricted jurisdictions is strictly prohibited.
9. Disclaimer
Arbitr Data are provided “as is” without warranties of any kind.
Arbitr Inc disclaims liability for accuracy, completeness, or fitness for purpose.
Arbitr Inc and USPTO are not affiliated.
10. Limitation of Liability
To the fullest extent allowed by law:
  • Arbitr Inc is not liable for indirect, special, or consequential damages;
  • Total liability is limited to fees paid in the preceding 12 months.
11. Termination
This License terminates automatically upon breach.
Licensee must delete all Arbitr Data copies and any models or caches enabling reconstruction.
Liquidated damages: triple annual fee or USD 50 000, whichever is greater.
12. Governing Law & Dispute Resolution
Unless otherwise specified in the Order Form:
Governing Law — State of Delaware, USA
Dispute Resolution — Binding Arbitration (JAMS, New York, in English).
